Bullying and Harassment in New Jersey Education Law
All children, including those with special needs, now have the legal right to be safe from bullying – and this includes cyberbullying. Following the 2011 New Jersey Anti-Bullying Bill of Rights Act, school districts have strict legal obligations when it comes to the investigation and enforcement of anti-bullying protocols. Parents have the right to request, defend or appeal any formal bullying investigation or decision.
Bullying and harassment in schools can have devastating effects on a student’s emotional well-being, academic performance, and overall safety. At SGW, we are committed to addressing and resolving incidents of bullying and harassment within New Jersey’s educational system, ensuring that every student has a safe and supportive environment in which to learn.
New Jersey has some of the nation’s strongest anti-bullying laws, including the Anti-Bullying Bill of Rights Act, which mandates strict procedures for schools to follow when addressing bullying and harassment. Our services in this area include:
- Reporting and Investigation: We assist in properly reporting incidents of bullying and harassment to school officials and ensure that the school conducts a thorough and impartial investigation in compliance with New Jersey laws.
- Advocating for the Victim: We advocate on behalf of students who have been bullied or harassed, ensuring that their voices are heard and their concerns are taken seriously. We work to secure appropriate measures to protect the student and prevent further incidents.
- Holding Schools Accountable: If a school fails to take appropriate action or violates anti-bullying laws, we pursue accountability through legal channels, including filing complaints with the New Jersey Department of Education or taking legal action.
- Seeking Remedies: We help families seek remedies that may include changes to the student’s educational environment, counseling services, and other supports to ensure the student’s safety and well-being.
- Preventing Future Incidents: We work with schools to implement stronger policies and practices that prevent bullying and harassment, promoting a culture of respect and inclusion.
At SGW, our priority is to protect students from bullying and harassment and to ensure that schools fulfill their legal obligations to provide a safe learning environment. With our extensive experience in education law, we are dedicated to supporting students and their families in resolving these serious issues effectively.
